TRLF Successfully Defends Medical Malpractice Action
November 6, 2009 --- Wilson D. Rogers, III, Esq., of The Rogers Law Firm successfully defended a medical malpractice trial in the Essex Superior Court on behalf of a nurse. The Plaintiff had alleged that he had sustained injuries as a result of the attempted placement of a Foley catheter, first by the Nurse Defendant and subsequently by a Physician Co-Defendant. Specifically, the Plaintiff sustained injuries to his urethra and rectum, allegedly as a result of the placement of the catheter.
TRLF Secures Defense Verdict in Wrongful Death Action
October 30, 2009 --- Wilson D. Rogers, III, Esq., of The Rogers Law Firm, secured a defense verdict in a wrongful death action in Suffolk Superior Court on behalf of a nurse practitioner and two registered nurses. The case alleged that the nurse practitioner and the registered nurses were negligent with respect to their assessment and evaluation of a premature newborn who developed necrotizing enterocolitis. After a two-week trial, the jury returned a verdict finding that the nurse practitioner and the registered nurses were not negligent.

Wilson D. Rogers, Jr., Esq. recently gave a presentation at the Hingham Branch of Boston Private Bank and Trust Company on positioning closely held companies, including health care organizations, for sale or merger. Wil discussed the different types of sales and mergers as well as the importance of confidentiality and non-disclosure agreements as part of any such transaction. Wil also detailed the need for creating a comprehensive due diligence plan as part of any sale or merger of a closely held company.
An editorial from Mark C. Rogers, Esq., entitled “Health Care Plan Needs Patient Accountability”, was published in the June 24th edition of the Patriot Ledger. In the editorial, Mark proposes that any effort to overhaul our nation's health care system with the intention of reducing health care costs needs to include specific mandates for patient accountability with respect to their own care and treatment. Pommersheim, Esq. is quoted extensively in an article appearing in this month's issue of Medical Office Billing & Collections Alert, a national publication of The Coding Institute, focusing on medical diagnosis coding, reimbursement and compliance. The article, entitled “Employ Promissory Notes and Payment Agreements”, sets forth how providers can utilize promissory notes and payment agreements as methods to collect on past due payments for services which have been rendered to patients.

Defense Verdict on Behalf of Nurse
January 22, 2009 --- Wilson D. Rogers, III secured a defense verdict in a wrongful death action brought against a nurse in a case in which a pregnant woman in an Emergency Room setting was provided an allegedly contraindicated medication.

Defense Verdict on Behalf of Surgeon
October 10, 2008 --- Wilson D. Rogers, III secured a defense verdict for a surgeon in an action in which, incident to a breast biopsy, a guidewire was unintentionally cut, could not immediately be located and was left behind by the surgeon in the patient's breast. Two years later, after alleging significant pain and discomfort, the patient had the piece of guidewire surgically removed.

Defense Verdict on Behalf of Cardiologist
June 19, 2008 --- Wilson D. Rogers, III secured a defense verdict for a cardiologist in a wrongful death action in which it was alleged that the cardiologist failed to diagnose an aortic aneurysm, resulting in a patient's death.
